Do I need a lawyer? It is the seller's prerogative to elect an attorney to attend to registration of transfer of immovable property into the name of the purchaser. You may also sell your home privately with the help of your attorney who can draft an agreement to suit the requirements of both parties and to help you sort out the Grey areas! Contrary to popular belief, the estate agent does not have the right to appoint the attorney. It is your choice, so exercise your right in this regard. Avoid impractical clauses and conditions that are often not capable of being implemented by letting your attorney peruse and advise you on any written offer prior to your signature, and insist on appointing your own attorney.
